
If you aren't satisfied with my services, I will cancel the listing agreement.
The Greater Las Vegas Association of Realtors listing contract includes no verbiage for terminating the contract so I add the following to all my listing agreements. Note that short sales are different. See Short Sales for details if you are interested.
"At Seller’s sole discretion, Seller can terminate this agreement upon five (5) days written notice to Eric Fernwood and (a) Return of all marketing materials provided by Eric Fernwood. (b) Written acknowledgment that Seller will not use Eric Fernwood’s marketing materials or derivations of said marketing materials or allow said materials to be used by any other to market Seller's property or any other property. (c) Written acknowledgment that paragraph 6(c) of this document will survive the termination of the agreement."
Paragraph 6(c) of the listing agreement (attached) states that if someone sees the property while I have the listing and purchases the property within 90 days after termination of the contract, you will still owe my brokerage the commission. See the Purchase Agreement FAQ for contract details.
I've had the above in all my listings and no one has ever exercised it. I doubt that you will either.
